Sue it! Sue it Good: Devo Sues McDonald’s

In other news, the guys from Devo are approximately 1,078 years old, according to this photo evidence:

Anyway, it seems that back in April, McDonald’s had music-era themed Happy Meal toys based on American Idol characters.  [Really? That’s amazing… how ever did I miss such a hot collectible?] One of them was “New Wave Nigel,” and he was wearing the “copyrighted energy cap” that Devo is known for, as well as an outfit that looks like the ones Devo wear.  Now, McDonald’s could argue New Wave Nigel had been in prison for drug possession, when it came to the outfit… the hat would be a bit harder to get around.  They could invoke LEGO, but having worked with them at an old job, I can safely say you don’t want LEGO even sightly miffed at you, much less suing your burger-peddling ass.

The suit also contends that New Wave Nigel’s song sounded like a Devo song.

Gerald Casale, of the band, said: “We’re in the midst of suing them… they didn’t ask us anything. Plus, we don’t like McDonald’s, and we don’t like American Idol, so we’re doubly offended.”

I don’t like McDonald’s and I don’t like American Idol. Please, oh please, let one of them offend me so I can sue them and maybe get myself a nice little house.  Honestly, all I need is a little one-bedroom with air conditioning….
